LETTER OF EXPLANATION
TIME SENSITIVE: SEPTEMBER 30, 2022 DEADLINE
Dear TommyBuilt Tactical T36 Owner:
As you should know by now, your TommyBuilt Tactical T36 has been classified by ATF as a machinegun receiver. ATF determined that the blocks and restrictions manufactured into our semi-automatic receiver (which were based on the SL8 prevention method) are insufficient and require an auto sear block on this platform. We’ve objected to this classification, but we do not control the firearms regulations or their enforcement.
In response, we at TommyBuilt Tactical offered to help all T36 owners. We advised that T36 owners have three (3) options to come into compliance with Federal law:
Option 1 - Upgrade: TommyBuilt Tactical manufactured, and ATF approved, an upgraded semi-automatic “TG36” receiver which includes more restrictive blocks, the newly required auto sear block, and other various upgrades. ATF has authorized TommyBuilt Tactical to replace existing T36 receivers with upgraded TG36 receivers. There will be a minimal cost to you of $225 to upgrade to the new TG36 receiver, and our website (www.tommybuilttactical.com) has instructions on how to send in your receiver for replacement.
Option 2 - Surrender: You may surrender the firearm receiver to ATF. This option would result in the loss of the firearm receiver, but you may continue to possess the other parts of the firearm. Please call the ATF Baltimore Field Division at (443) 965-2000 if you want to pursue this option.
Option 3 - Destroy: You may destroy the T36 firearm receiver in a manner approved by ATF. This option would result in the loss of the firearm receiver, but you may continue to possess the other parts of the firearm. Please call the ATF Baltimore Field Division at (443) 965-2000 if you want to pursue this option.
ATF HAS IMPOSED A HARD DEADLINE OF SEPTEMBER 30, 2022 TO TAKE ACTION. After that date, you will be contacted directly by ATF, and your T36 will be subject to seizure and forfeiture. Once seized, you will lose your entire T36 assembly. The resolution that we are offering will allow you to keep your components in an upgraded state at a minimal cost.
So we are clear, there is no current intent by ATF to pursue TommyBuilt Tactical or any T36 owner for criminal prosecution or wrongdoing. However, it is critical that you take immediate action to complete one of these three options by September 30, 2022, as machineguns manufactured after May 19, 1986 may not be possessed by private individuals. 18 U.S.C. § 922(o).
We want to thank the hundreds of you who have already upgraded to the TG36 receiver, but there are still more of you that need to take appropriate remedial action.
